OSH Act and OSHA: do not mix them
Guyana's Occupational Safety and Health Act is a local statute. US OSHA is a benchmark unless counsel says otherwise.
What the official sources say
Guyana's workplace statute is the Occupational Safety and Health Act 32 of 1997, administered through the Ministry of Labour. Official copies conflict on chapter and section numbering. Penalty rows taken from the Labour-hosted consolidation are on the penalties page with a verify-with-counsel flag. They are not published here as the settled current numbers.
US OSHA, including process safety management, does not follow an American employer to Guyana automatically. On this site it is a labelled benchmark unless counsel establishes a real US nexus. A gap against that benchmark is not described as a US statutory violation, and it is not described as a breach of the Guyana Act either.
Checklist
- Name the statute: Occupational Safety and Health Act, or OSHA benchmark. Not both on one row.
- Keep training, incidents, and corrective actions as evidence with owners.
- Do not copy a fine from the conflicting OSH consolidation into a report without the flag.
- Do not call a Guyana site a US OSHA violation by default.
- Link the Labour Ministry for the official text.
Questions people ask
Is OSHA the law on a Guyana worksite?
The Guyana statute is the Occupational Safety and Health Act. US OSHA is not automatic extraterritorial law. Treat US OSHA as a benchmark unless counsel establishes jurisdiction.
Why is there no single OSH fine on this page?
Official copies conflict on numbering. The catalogue shows the Labour-hosted text only with a verify-with-counsel flag. This guide does not repeat those amounts as if the conflict were resolved.
Does an HSE software score replace the Act?
No. An incident module, a checklist, and the statute are different things. Coverage in PetroMetric is accepted evidence, not a legal result.
